"Company" refers to HYPE. "Country" refers to the United States. "Service" refers to the HYPE Nightlife mobile application. "You" means the individual accessing or using the Service.
Acknowledgment
By accessing or using the Service You agree to be bound by these Terms. You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.
User Accounts
You must provide accurate, complete, and current information. You are responsible for safeguarding your password and all activities under your account. You agree not to disclose your password to any third party.
Content Restrictions
You may not transmit any Content that is unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable, including:
- Unlawful or promoting unlawful activity
- Defamatory, discriminatory, or mean-spirited content
- Spam, unauthorized advertising, or gambling
- Viruses, worms, malware, or harmful code
- Infringing on any proprietary rights of any party
- Impersonating any person or entity
- False information and features
Prohibited Conduct
- Create fake check-ins or manipulate crowd level data
- Check in to venues when not physically present (within 100 feet)
- Use the service for illegal purposes or to harass others
- Attempt to access other users accounts or private data
- Upload viruses, malware, or harmful code
- Scrape, data mine, or extract data from the service
Violation of these terms may result in immediate account termination and legal action.
Check-In Requirements
- Users must be within 100 feet of venue to check in
- Fake check-ins are prohibited
- Users must be 18+ years old
Subscription Information
HYPE Nightlife offers the following auto-renewable subscriptions:
- HYPE VIP Monthly — 1 month, auto-renewing
- HYPE VIP Annual — 1 year, auto-renewing
Payment will be charged to your Apple ID at confirmation of purchase. Subscription automatically renews unless cancelled at least 24 hours before the end of the current period. Manage or cancel in your App Store account settings.
User-Generated Content
By using HYPE and creating check-ins or other content, you grant HYPE and its successors a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use, reproduce, display, distribute, modify, and exploit your content for any purpose related to operating, promoting, improving, or monetizing the HYPE service.
Intellectual Property
The HYPE name, logo, design, interface, and all proprietary content are the exclusive property of Jaylin Redmond. HYPE and related marks are trademarks of Jaylin Redmond. All rights reserved.
Termination
HYPE reserves the right to suspend or terminate your access at any time, with or without cause, and with or without notice. Upon termination, your rights to use the service cease immediately.
Dispute Resolution
These terms are governed by the laws of the State of Georgia. Any disputes will be resolved through binding arbitration. You waive your right to a jury trial and to participate in class action lawsuits.
Limitation of Liability
The entire liability of the Company shall be limited to the amount actually paid by You or 100 USD. HYPE is not responsible for venue safety, accuracy of crowd data, or incidents at venues. Use at your own risk.
Changes to These Terms
We reserve the right to modify or replace these Terms at any time with at least 30 days notice.
